A business owners plans to remove a condition previously agreed by council officers on a proposed new development have been refused by council officers.
SRJ Convenience Ltd as the applicant approached Hartlepool Borough Council in a bid to remove a planning condition previously approved by council officers that restricted the proposed hours of business the applicant must adhere to in order to comply with planning regulations.
The plans would have meant that the operation of the business which is currently set to be developed back into its former use as a petrol station could have operated 24 hours a day, however concerns over noise & disturbance from vehicles on the forecourt at unsociable hours & its close proximity to residential dwellings led to council officers including that of HBC's public protection to look upon the request unfavourably, with council officers agreeing that the application must be refused & the original conditions imposed.
The former had car washing business is reportedly set to be redeveloped back into its former use as a convenience store & petrol station, however following those plans being approved, the site then became the target for vandalism & arson attacks.
A number of local residents submitted objections to the proposed change of the opening hours of the new development which is still yet to get off the ground, with many citing concerns over noise.
Council officers agreed with the pubic & issued a decision notice to refuse permission for the applicant to be discharged from the planning condition regarding permitted opening hours.
Theres currently no indication of whether the applicant will appeal the councils decision....
